Please read these Terms and Conditions carefully before using mariapairitz.com or placing an order. By accessing our website or making a purchase, you agree to be bound by these Terms.
1. About Us
mariapairitz.com is owned and operated by Maria Christine Pairitz, trading as Maria Pairitz, based in Indiana, United States.

2. Eligibility
By placing an order, you confirm that you are at least 18 years of age, legally capable of entering into a binding contract, and that all information you provide is accurate and complete.
3. Products
Original Paintings
Each original painting is a unique, one-of-a-kind work of art. Colors may vary slightly from screen representations due to monitor calibration. Dimensions listed are approximate.
Prints
Prints are high-quality reproductions fulfilled by Printful. Colors and finish may vary slightly between print runs. Prints are not signed unless explicitly stated in the product listing.
Merchandise
Merchandise items are produced and fulfilled by Printful. Product specifications are as listed on each product page.
Commissions
Commission orders are subject to a separate Commission Agreement provided and agreed upon before work begins. Key terms:

A non-refundable deposit of 50% of the agreed commission price is required to reserve a slot and commence work.

The final artwork will be shared with the client for approval before shipping. Minor revisions may be accommodated at the artist's discretion.

Commissions are licensed for personal, non-commercial use only unless a commercial licence is separately agreed.

Estimated completion timelines are provided in good faith and may be subject to change.
4. Pricing
All prices are listed in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice, except for orders already confirmed. International customers are responsible for any applicable customs duties, import taxes, or VAT in their country.
5. Orders & Payment
A contract is formed when we send you an order confirmation email. We reserve the right to decline any order at our discretion.

Payment must be made in full at the time of ordering (except commissions, which require a 50% deposit).

We accept payment methods as displayed at checkout on our Wix website.

We do not store your full payment card details.
6. All Sales Final
All sales at Maria Pairitz are final. We do not accept returns, exchanges, or cancellations once an order has been placed and confirmed, except as set out below.
We do not offer refunds for:
change of mind, color variation between screen and print, customs delays or fees, or damage caused after delivery.
Exception
Damaged or Incorrect Items: If your item arrives damaged in transit, or if you receive an incorrect item, please contact us at info@mariapairitz.com within 48 hours of delivery with photographic evidence. We will assess each claim on a case-by-case basis and, where appropriate, offer a replacement or store credit.
Note for International Customers
Customers in the EU, UK, or other jurisdictions may have statutory consumer rights that cannot be excluded by contract. Nothing in these Terms limits any rights you have under applicable mandatory consumer protection laws in your country.
7. Intellectual Property
All artwork, images, text, and designs on mariapairitz.com are the exclusive intellectual property of Maria Christine Pairitz (trading as Maria Pairitz).

Purchasing a product does not transfer any intellectual property rights to the buyer.

You may not reproduce, copy, distribute, or create derivative works from any artwork without prior written permission.

Prints and merchandise are for personal, non-commercial use only.

You may share images of purchased artwork on social media provided you credit Maria Pairitz as the artist.
8. Limitation of Liability
To the fullest extent permitted by law, Maria Pairitz and Maria Christine Pairitz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability to you shall not exceed the amount paid by you for the specific product giving rise to the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Indiana, United States. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Indiana. Nothing in this clause affects any mandatory consumer rights you have under the laws of your own country.
10. Changes to These Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our website constitutes acceptance of the revised Terms.
